Terms of Service
This page is only available in English. We keep our legal pages in a single language so the exact wording — and your rights under it — never gets lost or changed in translation. If you use your browser’s built-in translation, treat it as a convenience only: the English text here is what applies.
In plain English
- Binder Blitz is a tool that helps you write trading-card listings faster. It is assistive: AI can be wrong, so you check every listing before you publish it.
- You must be 18 or over. Keep your account secure and use the service lawfully.
- You keep ownership of your photos and content. We own the software and brand.
- Credits, plans, refunds and payments are explained on the Payment information and Refund policy pages, which form part of these terms.
- Your legal rights as a consumer are not affected by anything here.
1. Who we are and what these terms cover
These terms are a contract between you and Binder Blitz, trading as Binder Blitz (“we”, “us”), of 3 Iyshas Terrace, Banner Lane, Newport, Isle of Wight, PO30 5GE, United Kingdom. You can reach us at keironjwest@gmail.com.
They apply when you visit our website, create an account or use the Binder Blitz web app and tools (the “service”). They incorporate our Privacy Policy, Acceptable Use Policy, Refund Policy, Payment information and Cookie Policy. If you join the affiliate programme, the Affiliate Terms apply too. By creating an account, or ticking the box to accept them, you agree to these terms. We record the time and version you accepted (currently version 2026-09-21).
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract. If you sign up for a business, you confirm you are authorised to bind it.
- Give accurate information and keep it up to date. Keep your password confidential and tell us straight away if you think your account has been compromised. You are responsible for activity under your account.
- One person or business may hold one free account. Creating several accounts to collect free credits is an abuse of the service (see the Acceptable Use Policy).
- Accounts are personal. You may not sell, share or rent your account or its credits.
- You may not use Binder Blitz if you are located in, or ordinarily resident in, a country or region subject to comprehensive UK, EU, UN or US sanctions, or if you are named on a sanctions list. Our payment and marketplace partners apply the same restrictions.
3. The service
Binder Blitz is a web app that, among other things: reads trading-card details from photos using AI; generates eBay-ready titles, descriptions and item specifics; creates HTML listing themes (Theme Studio and the AI theme creator); provides in-browser image editing including background removal, crop and enhance tools; keeps a collection tracker; exports listings to CSV, HTML and other marketplace formats (such as Shopify, Square and TCGplayer files); optionally connects to your eBay account and publishes listings you choose to it; hosts carousel images for paid users; and offers an AI support chat, contact form and newsletter.
Features and plans change over time. Some features, such as the AI photo tools, image hosting and multi-marketplace exports, are limited to paid plans. We may add, change or remove features. If we remove a feature you have paid for in a way that materially reduces what you bought, we will tell you and you may cancel and claim a proportionate refund of the unused part of your current period.
4. AI output is assistive, not authoritative
You must review and take responsibility for everything you publish. In particular:
- AI can misread or misidentify a card (name, number, set, edition, language, parallel or variant), invent details, and miss condition issues.
- Nothing the service produces is an appraisal, a guarantee of authenticity, a grade or a statement of condition or value. You are responsible for verifying card identity, condition, grading claims and authenticity before you list.
- We do not guarantee that any listing will sell, at any price, or that it will be accepted by any marketplace.
- Where AI text or images might mislead a buyer, you must correct it. Using output to mislead buyers is prohibited.
Binder Blitz is an independent product. It is not affiliated with, endorsed by or sponsored by eBay, Pokémon, Wizards of the Coast, Konami, Bandai, Panini, Topps, PSA, Beckett (BGS), CGC, SGC, TCGplayer, Shopify, Square, or any other marketplace, publisher or grading company; those names are used only to describe what our tools work with, and belong to their owners. The rules of any marketplace or platform you use (for example eBay’s seller policies, VeRO and item-specifics rules) are your responsibility, and we are not a party to your dealings with buyers or marketplaces.
5. Plans, credits and payment
Our current plans are summarised below. Prices are in US dollars and exclude any tax that we must add (see Payment information).
| Plan | Monthly | Yearly | Credits |
|---|---|---|---|
| Free | $0.00 | – | 25 credits, one time only |
| Seller | $14.99 | $143.90 | 400 per 30-day cycle |
| Pro | $39.99 | $383.90 | 1,500 per 30-day cycle |
| Power Seller | $79.99 | $767.90 | 5,000 per 30-day cycle |
Credit top-ups: 300 credits for $8.99 and 1,000 credits for $24.99. AI actions cost credits: 1 for a card auto-read, 2 for an AI condition check, 3 for AI theme creation. Image Studio (crop, straighten, background remove, auto-crop and enhance) is free and unlimited on every paid plan. New subscribers to the Seller and Pro plans may receive a 20% welcome discount on their first month; it is available only to first-time subscribers.
- Subscriptions renew automatically each month or year until you cancel. You can cancel at any time in two clicks from the billing portal in your account. Cancelling stops the next renewal; you keep the plan until the end of the period you have paid for.
- Credits for paid plans are added every 30 days. Unused subscription credits carry over while your subscription is active. Top-up credits do not expire while your account is active. The Free plan’s 25 credits are one-time. Credits have no cash value, cannot be transferred or exchanged for money, and are forfeited if your account is closed or terminated for breach. If an AI action fails to deliver a result, the credits are returned to your balance automatically.
- Price changes. We will give at least 30 days’ notice by email of any price change affecting an existing subscription. It applies from your next renewal after the notice period, and you may cancel before then.
- Payments are processed by Stripe (cards) and NOWPayments (crypto passes). We never see your card number. Crypto purchases are prepaid access passes and do not renew automatically.
- Refunds are governed by our Refund Policy, which includes your statutory cancellation rights.
- If a payment fails we may retry it, and if it cannot be collected we may downgrade your account to the Free plan.
6. Your content
You keep all rights in the photos, text, data and other material you upload or create using the service (“your content”). We do not claim ownership of it. You give us a limited, worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process and display your content, and to send it to our sub-processors (such as our AI provider), only as needed to provide, secure and support the service for you, and to host carousel images you choose to publish. This licence ends when your content is deleted, subject to backup cycles.
You confirm that you own your content or have the right to use it, that it does not infringe anyone else’s rights, and that it complies with our Acceptable Use Policy. Carousel images are deleted 7 days after your paid subscription lapses; keep your own copies of anything you need. We do not use your photos to train AI models (see the Privacy Policy).
7. Acceptable use
You agree to follow our Acceptable Use Policy. In short: do not sell counterfeit, fake or misdescribed cards; do not alter grading labels; do not infringe others’ rights; do not abuse the AI or credits system; do not attack or overload the service; and comply with the rules of the marketplaces you sell on.
8. Our intellectual property
We and our licensors own the service, including its software, design, text, logos and branding. We give you a personal, non-exclusive, non-transferable, revocable right to use the service as permitted by these terms. You may not copy, reverse engineer, resell or create derivative works from the service, or scrape it, except as the law permits despite this restriction. Themes and listing text you generate for your own listings are yours to use in your own selling. Feedback you send us may be used by us without obligation to you.
9. Third-party services
The service works with third-party services such as eBay, Stripe, NOWPayments and Anthropic. They have their own terms and privacy policies, and we are not responsible for them. If you connect your eBay account, you authorise us to use the tokens you provide to act on eBay on your behalf as you instruct. You can disconnect at any time from the app; you should also revoke access in your eBay settings if you wish.
10. Availability and changes to the service
We work to keep the service available but we do not guarantee uninterrupted or error-free operation, and we give no uptime commitment. We may need to suspend the service for maintenance, security or reasons beyond our control. Because we may use budget hosting, the first request after a quiet period can be slow (a “cold start”). Do not rely on the service as your only copy of any data; export what you need.
11. Business and consumer users
Most of our users are sellers who use Binder Blitz in the course of a business. If you use the service in the course of a business, these terms are business-to-business terms and the limits and exclusions in this document apply to you as far as the law allows. If you are a consumer (acting wholly or mainly outside your trade, business, craft or profession), you also have statutory rights that these terms do not remove; for example, in the UK the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, in the EU the consumer protection laws of your country, and in Australia the Australian Consumer Law. If there is a conflict, your mandatory consumer rights prevail.
12. Suspension and termination
- By you: you can stop using the service and delete your account at any time from the Account page. Cancelling a subscription is separate; see section 5.
- By us: we may suspend or terminate your account, with notice where practicable, if you materially or repeatedly breach these terms or the Acceptable Use Policy, if we must do so to comply with the law, or to protect the service or other users. Where a breach can be fixed, we will usually warn you first. We may act immediately for serious abuse such as fraud, malware or illegal content.
- Effect: your right to use the service ends. Credits are forfeited if the account is closed or terminated for breach. Carousel images are deleted as described in our Privacy Policy. If we terminate your paid plan without your breach, we will refund the unused part of the period you paid for. Sections that by nature should survive (ownership, liability, governing law, and so on) survive termination.
13. Disclaimers
To the extent the law allows, the service is provided “as is” and “as available”. We do not promise that it will meet your particular needs, that AI output will be accurate, complete or fit for a particular purpose, or that any marketplace will accept your listings. Nothing in these terms excludes or limits any warranty, guarantee or right that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law and statutory rights of UK and EU consumers that digital services be provided with reasonable care and skill and as described.
14. Limitation of liability
- What we never limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited, or affects your statutory consumer rights.
- Consumers. We are responsible for foreseeable loss and damage caused by our breach of these terms or our negligence. We are not responsible for loss that was not foreseeable when the contract was made.
- Business users. To the extent the law allows, we are not liable for lost profit, lost sales, loss of business, loss of goodwill, loss of data or any indirect or consequential loss, and our total liability arising out of or in connection with the service in any 12-month period is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
- We are not liable for losses caused by your failure to check AI output, by marketplace decisions (such as delisting or account restrictions), or by events outside our reasonable control.
15. Indemnity
If you are a business user, you agree to compensate us for losses, liabilities and reasonable costs (including reasonable legal fees) arising from claims by third parties caused by your content, your listings or your breach of these terms or the law, for example a claim that an item you listed is counterfeit. This does not apply to consumers to the extent it would give you fewer rights than the law provides.
16. Complaints and dispute resolution
If something has gone wrong, please contact us first at keironjwest@gmail.com and give us a chance to put it right. We aim to reply within 3 business days and to resolve complaints promptly. We do not currently commit to use an alternative dispute resolution (ADR) body, but we will consider doing so if you ask, and if a certified ADR body is relevant to your complaint we will tell you if we agree to use it. The European Commission’s online dispute resolution platform was discontinued on 20 July 2025, so we do not refer to it. Nothing here stops you going to court or to a regulator or consumer body in your country.
17. Governing law and courts
These terms, and any dispute arising from them, are governed by the law of England and Wales. If you are a business user, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may bring proceedings in the courts of England and Wales or, if you live elsewhere, in the courts of your country of residence, and you keep the protection of the mandatory consumer laws of your home country whatever this clause says.
18. Changes to these terms
We may update these terms, for example to reflect new features or changes in the law. For material changes we will give you at least 30 days’ notice by email or in the app before they apply to you. If you do not agree, you may cancel before the change takes effect and (for a prepaid period you have already paid for) claim a proportionate refund of the unused part. Continuing to use the service after the change takes effect means you accept it. Changes required by law or that clearly benefit you may take effect immediately.
19. General
- Force majeure. Neither of us is liable for delay or failure caused by events beyond reasonable control (for example internet, power or platform outages, natural disasters, war, industrial action or government action). This does not excuse payment obligations already due.
- Assignment. We may transfer these terms to a successor to our business, on notice. You may not transfer your rights without our written consent.
- Entire agreement. These terms and the pages they refer to are the entire agreement between us about the service and replace any earlier understanding. Nothing in this clause limits liability for fraud.
- Severability. If a part is found unenforceable, the rest continues to apply and the part will be limited to the minimum extent necessary.
- No waiver. A delay in enforcing a right is not a waiver of it.
- Third parties. Only you and we may enforce these terms, except where the law gives someone else rights.
- Notices. We will contact you at the email address on your account. Contact us at keironjwest@gmail.com (legal notices to 3 Iyshas Terrace, Banner Lane, Newport, Isle of Wight, PO30 5GE).
- Language. These terms are written in English; any translation is for convenience only.
